In April 2009, Lance Macpherson, a 52-year-old man with a history of mental disorders (most notably, schizophrenia) attempted suicide by throwing himself in front of a moving car in Montclair, California.

After surgery to repair injuries from that incident and extensive psychiatric evaluations that determined Lance remained at risk of harming himself if he were discharged to the community due to his depression, unpredictability and suicidal ideations, he was released from the hospital into the care of the Del Rosa Villa nursing home in San Bernardino, California on May 22, 2009. At Del Rosa Villa, Lance's family believed he could continue his recovery from surgery, while being placed on a strict suicide watch that required close supervision at all times by a skilled nursingThe Nurse is a major character in William Shakespeare's classic drama Romeo and Juliet. According to court documents, on the night of June 11, 2009, Lance's behavior deteriorated throughout the evening, whereupon he became visibly agitated, prompting several calls to his doctor in the late evening hours. At 12:30 a.m. on June 12, 2009 — despite strict suicide watch orders — several members of the nursing home staff allegedly watched as Lance wheeled himself out the door of the facility in his wheelchair. Approximately 20 minutes after Lance was seen exiting the facility, a passerby called the main desk to report a person hanging from the fence surrounding the property.

Court documents go on to state that when the staff arrived at the fence, they found Lance hanging from the end of his own belt, with the other end of the belt tied to the metal portion of the fence. Paramedics were called, but CPR attempts failed to resuscitate Lance. He was pronounced dead at approximately 1:30 a.m.

Del Rosa Villa, LLC Sued for Wrongful Death, Physical Elder Abuse and Negligence

This case is both a moral and legal outrage, said Brian Chase, a senior partner at BISNAR | CHASE. Lance suffered physical harm and, ultimately, his demise at the hands of Del Rosa Villa staff members who were aware of his severe mental disorders — professionals who allowed him to have items in his possession with which he could harm himself, who knowingly watched him leave their supervision and care, and who did absolutely nothing to protect him and prevent him from taking his own life.

According to the lawsuit, Del Rosa Villa failed to follow its own Policy and Procedure Regarding Suicide Threats document, disregarding strict suicide prevention measures that were outlined within that policy.

What's more, the nursing home staff allegedly failed to follow its own care plan for Lance and failed, even further, to read Lance's chart that outlined his mental disorders, his suicidal tendencies and his reasons for admission to the nursing home in the first place.

Therefore, if a lawsuit is filed against one of the nursing homes, the owners can declare bankruptcy of that nursing home but continue to run the other uninsured nursing homes.

The nursing home owners can take any stance they want — they can make any claim they want, said Chase. However, with this lawsuit, we are making a statement of our own. We are holding each one of them personally, directly, legally and morally responsible for Lance's death, for the pain and suffering he experienced leading up to his death and for the abuse he suffered at the hands of the negligent nursing home staff members they employed.

The lawsuit seeks damages for wrongful death liability, physical elder abuse, negligence, pre-death pain and suffering, and emotional and mental suffering sustained by Lance's surviving family members, in addition to loss of consortium and funeral and burial expenses.

Texass Medicaid Estate Recovery Program (MERP) is estimated to begin September 1, 2004. Many in Texas, including Houston elder-law attorney Wesley Wright, are concerned that Texans may not understand the bill or be aware of how it could effect them.

Starting September 1, when a Medicaid recipient dies, the state of Texas (through the Department of Health and Human Services) will be able to file a claim against the decedents estate in order to recover the cost of long-term care including nursing home fees, hospital care, and medicine costs. Anything considered as part of the probate estate — including homes, property and cash — is fair game for the state as a source of fund recovery.

According to the Texas Health and Human Services Commission (HHSC), only 292 people attended the 6 public forums held by the HHSC on the topic throughout the state this year. Mr. Wright finds this disturbing considering the number of people affected by the statute. Many seniors are not concerned with Medicaid legislation because they think it does not apply to them. But with the staggering financial costs of long-term care (around $45,000 – $61,000 per year), the truth in Texas is that 7 out of 10 nursing home patients rely on Medicaid to pay the bill, he explains.

But before seniors and their families start to panic, Mr. Wright advises that they learn all the facts. There are substantial limits as to what Texas can access for fund recovery and when they can access it, he says. For example, the state cannot file against a decedents estate if the spouse is still living. Anyone currently on Medicaid for long-term care as of September 1, 2004, is exempt from recovery. Even if a person becomes at risk of recovery, there is a proposed $50,000 automatic exemption on all homesteads.

Sanford-Brown College-St. Peters has received approval to offer a Bachelor of Science in Nursing (BSN) degree; the culmination of a process that began in early 2007. The program, which is accredited through the Accrediting Council of Independent Colleges and Schools (ACICS) and approved by the Missouri Department of Higher Education (MDHE), allows registered nurses with a diploma or an associate degree from an accredited college or university to earn a Bachelor of Science degree at Sanford-Brown College-St. Peters. The first class started in early January.

We are very excited about this new program. said Julia Leeman, college president, This is an opportunity for our current and future students to advance their education; and for our nursing alumni to take their careers to the next step.

The 60-week program consists of a blended-learning environment which includes campus and online learning and was built around a holistic model of care with focused areas in clinical practice, research, education and administration/management.

Recently, the college selected Michelle M. Hopper RN, BSN, MBA, CNA, BC, CCRN, to serve as nursing program chair. Before joining Sanford-Brown-St. Peters in 2006, Hopper, a Manchester resident, served as director of nursing, for the cardiovascular service line at St. Johns Mercy Medical Center, St. Louis. While at St. Johns, she also served as area manager for the post-anesthesia care unit and was a nurse manager.

The online portion of the BSN is fairly unique, said Hopper. Our students can expect to integrate critical thinking and apply knowledge by using case scenarios, simulation, journal entries, researching periodicals and the Internet and peer-assessment.

The on-campus and online instruction are delivered through a variety of methods. Hopper and Edwards worked together for almost a year, constructing the program. According to Edwards, there was tremendous input from the nursing faculty and Todd Pearson, director of education for Sanford-Brown St. Peters. We discussed the courses and objectives; the length of the program and, most important, adopting the principles our faculty-selected nursing theorist, Dr. Betty Newman. Edwards said.

Dr. Newman developed the theory of health as an expanding consciousness. The conceptual framework of this theory addresses family dynamics and community interactions as well as the holism of a person's experience and being in relationship to disease

Simply put, the BSN completion program, at Sanford-Brown-St. Peters, places focus and emphasis on wellness and holistic medicine resulting in positive patient outcomes.

The typical student, according to Leeman, is a registered nurse with a strong interest in progressing bed-side skills; leadership development and an applied research role. The program is on a five-week cycle; with the next classes beginning on February 11.
